Terms and conditions

Terms and conditions

Here your can read about the terms of using any of TROOPRs services.

    1. Acceptance of the User Agreement

By creating a TROOPR account, whether through a mobile device or mobile application (collectively referred to as the “Service”), you agree that you are bound by (i) these terms of use, (ii) our privacy policy, and (iii) other terms that you are informed of and agree to when purchasing additional features, products, or services we offer through the Service (collectively referred to as this “Agreement”). If you do not agree and consent to be bound by all the terms of this Agreement, you should not use the Service.

We may, from time to time, make changes to this Agreement and the Service. We may do this for various reasons, including reflecting changes in or requirements of the law, introducing new features, or changing business practices. The latest version of this Agreement will be posted on the Service under Settings and also at https://troopr.app/. You should regularly review the latest version. The latest version is the version that applies. If the changes include significant changes to your rights or obligations, we will notify you of the changes at least 30 days in advance (unless applicable law prevents us from doing so) in a reasonable manner, which may include notification through the Service or via email. If you continue to use the Service after the changes take effect, you agree to the revised Agreement.

    1. Eligibility

You must be at least 16 years old to create an account on TROOPR and use the service. By creating an account and using the service, you certify that:

You can enter into a binding agreement with TROOPR.

You will comply with this Agreement and all applicable local, state, national, and international laws, rules, and regulations.

You have never been convicted of a serious crime or (or a crime of similar severity), a sexual offense, or any crime involving violence, and you are not required to register as a sex offender in any state, federal, or local registry.

    1. Your Account

To use TROOPR, you can log in with your Facebook login. If you do so, you allow us to access and use certain Facebook account information, including but not limited to your public Facebook profile. For more information on the data we collect from you and how we use it, see our privacy policy.

You are responsible for protecting your login information that you use to register on TROOPR, and you are solely responsible for all activities that occur under login with this information. If you believe someone has gained access to your account, contact us here or at privacy@troopr.app immediately.

    1. Modify or Terminate the Service

TROOPR always aims to improve the service and provide you with access to additional features that you may find engaging and useful. This means that we may add new product features or improvements from time to time and remove certain features, and if these actions do not materially affect your rights or obligations, we may not notify you before taking them. We may even terminate the service entirely, in which case we will notify you in advance unless there are circumstances, such as security issues, preventing us from doing so.

You can terminate your account at any time, for any reason, by contacting us here, but if you use a third-party payment, you must handle app purchases through such an account (e.g. iTunes, Google Play) to avoid additional billing. TROOPR may terminate your account at any time without prior notice if they believe you have violated this Agreement. In such termination, you are not entitled to a refund of purchases.

When your account is terminated, this Agreement ceases to apply, except for the following provisions that will still apply between you and TROOPR: sections 4, 5, and sections 12 to 19.

    1. Security; Your Interactions with Other Members

TROOPR encourages a respectful member experience but cannot be responsible for the conduct of other members on or off the service. You agree to be cautious in all interactions with other members, especially if you decide to communicate outside the service or meet in person. You agree not to provide your financial information (e.g. your credit card or bank account details) or transfer or otherwise send money to other members. You are solely responsible for your interactions with other members. You understand that TROOPR does not conduct a criminal background check on members or other investigations into members’ backgrounds. TROOPR makes no representations and provides no warranties regarding members’ conduct.

    1. Rights TROOPR Grants You

TROOPR grants you a personal, international, royalty-free, non-transferable, non-exclusive, revocable, and non-licensable license to access and use the service. This license is only intended to allow you to use and experience the benefits of the service as intended by TROOPR and as permitted by this Agreement. Therefore, you agree not to:

Use the Service or any content in the Service for commercial purposes without our written consent.

Copy, modify, transmit, create derivative works from, use, or reproduce copyrighted material, images, trademarks, service marks, or other intellectual property, content, or copyrighted information available through the Service without TROOPR’s prior written consent.

State or imply that any statements you make are endorsed by TROOPR.

Use any robot, bot, spider, web crawler, scraper, website search/retrieval application, proxy, or other manual or automatic device, method, or process to access, retrieve, index, extract data, or in any way reproduce or circumvent the navigational structure or presentation of the service or its content.

Use the service in any way that may interfere with or negatively affect the service or the servers or networks connected to the service.

Upload viruses or other malicious code or otherwise compromise the security of the service.

Create headers or otherwise manipulate identifiers to disguise the origin of any information transmitted to or through the service.

“Mirror” any part of the service without TROOPR’s prior written notice.

Use meta tags or code or other devices containing any reference to TROOPR or the Service (or any trademark, trade name, service mark, logo, or slogan of TROOPR) to direct any person to any other website for any purpose.

Modify, adapt, sublicense, translate, sell, recreate parts of, decrypt, decompile, or otherwise disassemble any part of the service or induce others to do so.

Use or develop third-party applications that interact with the service or other members’ content or information without our written consent.

Use, access, or publish the programming interface of the TROOPR application without our written consent.

Investigate, search or test the vulnerability of our service or any system or network.

Encourage or promote activities that violate this Agreement.

The company may investigate and take available legal action in response to illegal and/or unauthorized use of the service, including termination of your account.

All software that we provide to you may automatically download and install upgrades, updates, or other new features. You may be able to adjust these automatic downloads through your device settings.

    1. Rights Granted to TROOPR

By creating an account, you grant TROOPR an international, transferable, sublicensable, royalty-free, right and license to host, store, use, copy, display, reproduce, adapt, edit, publish, modify, and distribute the information you have allowed Facebook to share with us, as well as all information you post, upload, display, or otherwise make available (collectively “post”) on the service or transfer to other members (collectively “content”). TROOPR’s license for your content is non-exclusive, except that TROOPR’s license is exclusive with respect to derivative works created through the use of the service. For example, TROOPR has an exclusive license for screenshots of the service containing your content. Additionally, to enable TROOPR to prevent the use of your content outside the service, you allow TROOPR to act on your behalf regarding abusive uses of your content taken from the service by other members or third parties. Our license to your content is subject to your rights under applicable law (e.g., laws regarding the protection of personal data to the extent the content contains personal information as defined in these laws) and is for the limited purpose of operating, developing, providing, and improving the service and investigating and developing new services. You consent that any content you post, or approve us to post, on the service may be viewed by other members and may be seen by all persons who visit or participate in the service (e.g., persons who may receive shared content from other TROOPR members).

You agree that all information you submit upon the creation of your account, including information sent from your Facebook account, is accurate and truthful, and that you have the right to post the content in the service and grant the license to TROOPR as stated above.

You understand and agree that we may monitor or review any content you post as part of a service. We may delete any content, in whole or in part, that, in our opinion, violates this agreement or may harm the reputation of the service.

When communicating with our customer service representatives, you agree to be respectful and courteous. If, at any time, we deem your behavior towards any of our customer service representatives or other employees as threatening or offensive, we reserve the right to immediately terminate your account.

In accordance with allowing you to use the service, you consent to us placing advertisements on the service. By submitting suggestions or feedback to TROOPR regarding our service, you agree that TROOPR can use and share such feedback for any purpose without compensating you.

We inform you that TROOPR may access, store, and disclose your account information and content if required by law, in performing its agreement with you, or in good faith that such access, storage, or disclosure serves a legitimate interest, including: (i) complying with legal processes; (ii) enforcing the agreement; (iii) responding to claims that any content violates third-party rights; (iv) responding to your customer service requests; or (v) protecting the rights, property, or personal safety of the company or any other person.

    1. Community Rules

By using the Service, you agree not to:

Use the Service for any purpose that is illegal or prohibited under this agreement.

Use the Service with the intent to harm or disrupt.

Use the Service to harm TROOPR.

Send spam, request money from, or deceive other members.

Impersonate any person or entity or post pictures of another person without their consent.

Engage in bullying, stalking, threats, assault, harassment, abuse, or defamation.

Publish content that violates or infringes on anyone’s rights, including rights to publicity, data protection, copyright, trademark, or other intellectual property or contractual rights.

Publish any content that is hateful, threatening, sexually explicit, or pornographic.

Publish content that incites violence; or contains nudity or graphic or inappropriate violence.

Publish content that promotes racism, narrow-mindedness, hatred, or urges physical harm to any group or individual.

Request passwords for any purpose or personal identifying information for commercial or illegal purposes from other members or share another person’s personal information without their permission.

Use another member’s account, share an account with another member, or have more than one account.

Create a new account if we have already terminated your account unless you have our permission.

TROOPR reserves the right to investigate and/or terminate your account without a refund of purchases if you have violated this agreement, abused the service, or behaved in a way that TROOPR deems inappropriate or illegal, including actions or communications made through or outside the service.

    1. Other Members’ Content

While TROOPR reserves the right to review and remove content that violates this agreement, the member who posted the content is solely responsible for it, and TROOPR cannot guarantee that all content will comply with this agreement. If you encounter content on the service that violates this agreement, report it through the app’s support function or here.

    1. Purchases

General: Sometimes TROOPR may offer products and services for purchase (“in-app purchases”) via iTunes, Google Play, TROOPR direct billing, or other payment platforms approved by TROOPR. If you choose to make an in-app purchase, you will be prompted to confirm your purchase with the applicable payment provider, and your payment method (whether it’s your card or a third-party account like Google Play or iTunes) (“your payment method”) will be charged for in-app purchases at the prices displayed for the service(s) you have selected, plus any sales or similar taxes that may be imposed on your payments, and you agree that TROOPR or the third-party account, as applicable, may charge you. If you purchase an automatic recurring periodic subscription through an in-app purchase, your payment method will be charged for the subscription until you cancel. After your initial subscription period and again after any subsequent subscription period, your subscription will automatically continue for an additional equivalent period, at the price you agreed to when you initiated the subscription.

    Automatic Renewal; Automatic Card Payment:

Subscriptions are automatically renewed until you cancel the subscription. When you purchase a subscription, your payment method will continue to be billed monthly in advance within 24 hours of the day of the first purchase at the price you agreed to when you initiated the subscription. Your credit card information will be stored and then used for automatic card payments in accordance with the agreement.

Objections to a payment already made should be directed to support here, or through the in-app chat if you are billed directly by TROOPR or the relevant third-party account, such as iTunes. You can also make objections by contacting your bank or payment provider, which may provide additional information about your rights and applicable time limits.

You can withdraw your consent to automatic card payments at any time by going to Settings on TROOPR or the relevant third-party account, but keep in mind that you are still responsible for any outstanding amounts.

If you want to change or terminate your subscription, you must log in to your third-party account (or go to Settings on TROOPR) and follow the instructions to cancel your subscription, even if you have otherwise deleted your account with us or removed the TROOPR application from your device. Deleting your account on TROOPR or removing the TROOPR application from your device does not terminate or cancel your subscription. TROOPR retains all money charged to your payment method until you cancel your subscription on TROOPR or the third-party account. If you cancel your subscription, you can use your subscription until the end of your current subscription period, and your subscription will not be renewed after the term is over.

Additional Terms Applicable If You Pay TROOPR Directly with Your Payment Method: If you pay TROOPR directly, TROOPR may correct any billing errors or mistakes they make even if they have already requested or received payment. If you initiate a chargeback or otherwise cancel a payment made with your payment method, TROOPR may terminate your account immediately at their discretion.

You can edit your payment method by visiting TROOPR and going to Settings. If a payment cannot be processed because the card has expired, insufficient funds, or for any other reason, and you do not edit your payment information, cancel or terminate your subscription, you remain responsible for any unpaid amounts and allow us to continue billing the payment method, when updated. This may result in a change to your billing dates for payment. Additionally, you allow us to obtain updated or replacement expiration dates and card numbers for your credit or debit card provided by your credit or debit card issuer. Payment terms are based on your payment method and may be governed by agreements between you and the financial institution, credit card issuer, or other provider of your chosen payment method.

Virtual Items: Occasionally, you may purchase a limited, personal, non-transferable, revocable license to use “virtual items,” which may include virtual items or virtual “coins” or other units that can be exchanged for virtual products within the service (collectively referred to as “virtual items”). Balances for a virtual item do not constitute a real-world balance and do not represent any stored value but measure the extent of your license. Virtual items do not incur fees if not used, but the license granted to you in virtual items will terminate in accordance with the terms of this agreement when TROOPR ceases to provide the service or your account is otherwise closed or terminated. TROOPR reserves the right, at its discretion, to charge fees for the right to access or use virtual items and/or may distribute virtual items with or without charge. TROOPR may manage, regulate, control, modify, or eliminate virtual items at any time. TROOPR has no liability to you or any third party in the event that TROOPR exercises such rights. Virtual items can only be redeemed through the service. All purchases and redemptions of virtual items made through the service are final and non-refundable. The provision of virtual items for use in conjunction with the service is a service that commences immediately upon your purchase of such virtual items. You acknowledge that TROOPR cannot be required to refund virtual items for any reason, and you will not receive money or other compensation for unused virtual items when an account is closed, whether voluntary or involuntary.

Refunds: In general, no fees for purchases are refunded, and there are no refunds or credits for partially used periods. An exception may be made if a refund for a subscription offer is requested within fourteen days of the transaction date, or if the laws in your jurisdiction prescribe a refund.

For subscribers residing in the EU or the European Economic Area, you have the right, in accordance with local legislation, to a full refund without specifying a reason within 14 days of the subscription start. Please note that the 14-day period begins as soon as the subscription becomes effective.

To request a refund: If you made a purchase with your Apple ID, refunds are handled by Apple, not by TROOPR. To request a refund, go to iTunes, click on your Apple ID, select “Purchase History,” find the transaction, and press “Report a Problem.” You can also submit a request at https://getsupport.apple.com.

If you made a purchase using your Google Play Store account or directly through TROOPR: Contact us through the support function or here with the order number for Google Play Store (you can find the order number in the order confirmation or by logging into Google Wallet) or TROOPR (you can find this in your email confirmation). If you contact us directly by email or chat, also include your email address and phone number.

If you exercise your right to cancel the service (except for purchases made through your Apple ID, which Apple controls), we will refund (or ask Google to refund) all payments received from you without undue delay and in any event within 14 days from the date we received notice of your decision to terminate the agreement. We will make such refunds using the same payment method you used in the initial transaction. In any case, no fees will be charged to you as a result of the refund.

If you made a purchase via a payment platform not listed above, you need to request a refund directly from the third-party provider from which you made your purchase.

You cannot cancel an order for the delivery of digital content that is not delivered on a physical medium if order processing has begun with your express consent and confirmation that you will thus lose your cancellation right. This applies, for example, to the purchase of virtual items. Purchases of virtual items are final and not refundable.

Pricing: TROOPR operates a global business, and our pricing varies depending on various factors. We often offer promotions that may vary by region, subscription length, package size, and more. We also regularly test new features and payment options.

    1. Notices and Procedures for Making Claims of Copyright Infringement:

If you believe that your work has been copied and published on the Service in a way that infringes copyright, provide the following information to our Privacy Officer:

An electronic or physical signature of the person authorized to act on behalf of the owner of the copyright interest.

A description of the copyrighted work that you claim has been infringed.

A description of where the material you claim is infringing these rights is located on the Service (such description must be reasonably sufficient for us to locate the alleged material).

Your contact information, including address, phone number, and email address.

A written statement from you that you are acting in good faith belief that the disputed use is not authorized by the copyright owner, its agent, or the law.

A statement from you, made under penalty of perjury, that the above information in your notice is accurate and that you are the copyright owner or authorized to act on behalf of the copyright owner.

Claims of copyright infringement should be addressed to the company’s Privacy Officer via email at complaints@troopr.app or through our customer service [here](link to customer service).

TROOPR terminates the accounts of repeat infringers.

    1. Disclaimers:

Troopr provides the service “as is” and to the extent permitted by applicable laws and gives no warranties of any kind, either express, implied, statutory, or otherwise regarding the service (including all content in it), including but not limited to implied warranties of satisfactory quality, merchantability, fitness for a particular purpose, or non-infringement. TROOPR does not represent and warrant that i) the service will be uninterrupted, secure, or error-free, ii) any defects or errors in the service will be corrected, or iii) any content or information you obtain through the service will be accurate. TROOPR assumes no responsibility for any content you or any other member or third party post, send, or receive through the service. Any material downloaded or otherwise obtained through the service is used at your own risk.

    1. Third-Party Services:

The service may contain ads and promotions offered by third parties and links to other websites or resources. TROOPR is not responsible for the availability (or lack of availability) of such external websites or resources. If you choose to interact with third parties through content made available through our service, the terms of such parties will govern their relationship with you. TROOPR cannot be held responsible for such third-party terms or actions.

    1. Limitation of Liability:

To the extent permitted by applicable law, TROOPR, its affiliated companies, employees, licensors, or service providers shall not be liable for any indirect, consequential, incidental, or punitive damages, including but not limited to loss of profit, whether incurred directly or indirectly, loss of data, use, or goodwill, or any other intangible losses, arising out of or related to: (i) access to or use of or inability to access the service, (ii) the conduct or content of other members or third parties on the service, or that you access through the service, or (iii) unauthorized access, use, or alteration of content, even if TROOPR has been advised of the possibility of such damage. In no event shall TROOPR’s aggregate liability to you for all claims related to the service exceed the amount you paid, if any, to TROOPR for the service, up to a maximum of 1000 SEK, as long as you have an account. In certain jurisdictions, the exclusion or limitation of certain damages is not allowed, so some or all of these exclusions or limitations may not apply to you.

    1. Applicable Law and Dispute Resolution:

These general terms, and everything related to our services for you, are governed by and interpreted in accordance with Swedish substantive law without applying rules or principles of choice of law.

Any disputes arising from these general terms, engagement confirmation, our engagement, or our advice shall be finally settled by arbitration administered by the Arbitration Institute of the Stockholm Chamber of Commerce (“SCC”). The SCC Rules for Expedited Arbitrations shall apply unless the SCC, taking into account the complexity of the case, the value of the dispute, and other circumstances, determines that the Arbitration Rules shall apply. In the latter case, the SCC shall also determine whether the arbitration tribunal shall consist of one or three arbitrators. The place of arbitration shall be the location where your responsible partner is primarily based. The language to be used is Swedish, unless we agree to use English instead.

Arbitration invoked under this section and information disclosed during such proceedings, as well as any decision or award resulting from the proceedings, is subject to confidentiality and may not, in the absence of the express consent of the other party, be disclosed to a third party. However, a party shall not be prevented from disclosing such confidential information to preserve its rights in relation to the other party or if such duty exists under mandatory law or the like.

Notwithstanding the above, TROOPR always has the right to bring an action for overdue claims arising from the engagement or otherwise in courts or authorities (e.g., the Enforcement Authority) that have jurisdiction over you or any of your assets.

    1. Indemnification from You:

To the extent permitted by applicable law, you agree to indemnify, defend, and hold TROOPR, our subsidiaries and the subsidiaries of our respective managers, board members, agents, and employees harmless from any and all claims, demands, liabilities, damages, losses, costs, and expenses, including attorney’s fees, arising in any way related to your access to or use of the service, your content, or your breach of this agreement.

    1. Miscellaneous:

This agreement, together with the privacy policy and any other terms you are informed of and agree to when purchasing additional features, products, or services that we offer on the service, constitutes the entire agreement between you and TROOPR regarding the use of the service. If any provision of this agreement is found to be invalid, the remainder of this agreement shall continue in full force and effect. The company’s failure to exercise or enforce any right or provision of this agreement shall not constitute a waiver of this right or provision. You agree that your TROOPR account cannot be transferred and that all your rights to your account and its content cease upon your death. No agency, partnership, joint venture, fiduciary relationship, or employment is created as a result of this agreement, and you may not make any representations on behalf of or bind TROOPR in any manner.
